Saloton Oy's general terms and conditions
General terms and conditions valid from 1.11.2020. Saloton Oy (business ID: 2435975-5) reserves the right to amend these terms and conditions by unilateral decision without prior notice. Orders are subject to the terms and conditions in force at the time of ordering. Changes in the law shall enter into force immediately, unless otherwise provided by law.
These terms and conditions apply to products and services sold by Saloton Oy (hereinafter referred to as the Supplier) related to home maintenance and upkeep. The Service shall be performed by the Supplier's installers or subcontractors using equipment and methods specified by the Supplier and approved by the Customer. The Supplier shall be responsible for the proper and professional performance of the work.
The supplier sells services and products to adult individuals, companies and communities. The supplier reserves the right to change the prices indicated in the online shop.
The consumer legislation in force in Finland and the European Union applies to consumer transactions. The Finnish Commercial Code shall apply to the commercial contract between business customers and Saloton Oy, unless otherwise specified in these terms and conditions.
The customer (Subscriber) is obliged to provide full contact details when placing an order, including at least name, address, telephone number and e-mail address for a consumer customer.
The Client is responsible for ensuring that the Supplier has access to all necessary places on the site, for example, all necessary apartments in a housing company. The Supplier shall be responsible for cleaning up after his work in the apartment or other premises. The Contractor shall be responsible for the protection of valuable or sensitive objects and materials. The Client shall inform the Supplier of any particularly sensitive materials, equipment, pipes, etc. installed in contravention of building regulations, so that the Supplier can carry out the work with particular care and discuss any risks with the Client before carrying out the work. The Supplier shall not be liable for any damage or additional costs caused by solutions installed in violation of building regulations.
If the maintenance site or part of it is located in a particularly difficult location, requiring structural demolition work, the measures will be carried out as comprehensively as is possible with standard equipment without extensive demolition work, unless otherwise specified in the order confirmation. Where the work requires lifting/excavation equipment, the Supplier shall be entitled to charge the Customer for the cost of hiring such equipment, unless otherwise specified in the Contract.
The Contracting Entity shall be responsible for the consumption of electricity, water and energy during the work on the site. The contracting entity shall be responsible for the accuracy of the information provided. In the event of material errors in the information provided to the Supplier (e.g. floor area, number of floors/buildings or roofing material), the Supplier shall be entitled to charge the Client the difference between the price based on the incorrect information and the list price calculated on the basis of the actual data of the site.
The Supplier has the right to cite the work performed for the Customer as a reference, unless the Customer expressly prohibits this. Exact identification data (names of persons, exact street address, unless it is clear from the name of the housing company) shall not be indicated in the reference advertisements.
Delivery conditions
The prices given on the Saloton Oy website include, in addition to the work, the cost of delivery of equipment/materials and travel expenses to the work site, unless otherwise stated. The calculator will also give the estimated cost after the household deduction, however, the tax authorities will decide whether to allow the deductions for the Subscriber's tax purposes. In the case of items invoiced according to actuals, e.g. services marked ”Hourly work” (h), a 15 % variance will be accepted without special agreement. Prices quoted on the Saloton Ltd website include VAT at the current VAT rate. If the product offered/ordered is not available from the wholesaler or manufacturer, the Supplier shall be entitled to submit a new offer to the Customer with an alternative product and price.
Tilaaja sitoutuu jokaisen tilauksen yhteydessä voimass oleviin toimitusehtoihin. Sitova kauppasopimus astuu voimaan tilauksen kirjauduttua Saloton Oy:n tilausjärjestelmään. Saloton Oy- tarjoamat palvelut ovat saatavilla tietyille alueille Suomessa. Verkkokaupan postinumerovalitsin kertoo saatavuuden palvelukohtaisesti, mikäli palvelu on verkkomyynnissä.
The site must be accessed by a solid driveway. If the site is located on an island at the end of a waterway or in another difficult-to-access location, the Supplier shall be entitled to charge the Customer for the cost of travel and travel time.
Order confirmation and scheduling
The Supplier sends an order confirmation by e-mail, where the Subscriber can see the products and services ordered. If the delivery of the ordered service so requires, the Supplier will contact the Customer separately to agree on a time schedule.
Toimittaja suorittaa palvelun sovitussa aikataulussa, mutta mikäli aikataulua joudutaan muuttamaan ennakoimattomasta syystä, on Toimittaja yhteydessä Tilaajaan. Tietyt palvelut (esim. kattotyöt) suoritetaan säävarauksella. Mikäli vallitseva säätila estää palvelun suorittamisen ennakkoon sovittuna ajankohtana, Toimittaja tarjoaa uuden vapaan ajankohdan. Asiakas voi pyytää toista aikaa tai peruuttaa tilauksen tässä kohtaa. Taloyhtiöiden huoneistokohtaisista erityisaikataulutuksista Toimittajalla on oikeus veloittaa 50 eur / kpl sis. alv muiden sovittujen veloitusten lisäksi.
Payment methods
An order confirmation and an invoice will be sent to the Customer for the ordered works and materials. The Supplier shall invoice the Customer only after the work has been performed, except in cases where advance invoicing or an instalment plan has been agreed. The invoice shall be sent by e-mail, e-invoice and paper invoice by post. The payment method is bank transfer. Payment term 7 days net or as agreed.
The option to pay by instalments may be granted to a consumer customer with a good credit history. Instalment requests will be dealt with on a case-by-case basis. The Supplier has the right to check the Subscriber's credit history. The Supplier has the right not to grant credit to the Subscriber. In the event that an invoice is addressed to a third party at the request of the Subscriber, the Subscriber shall be ultimately responsible for the payment of all obligations to the Supplier.
Cancellation policy
The consumer-customer has the right to cancel the order within fourteen days of receipt of the order confirmation or as provided for in the Consumer Protection Act. Cancellation must be made by telephone or e-mail to the Supplier. If the cancellation is made less than 24 hours before the start of the agreed work, the Supplier is entitled to charge a cancellation fee of EUR 100 incl. VAT per apartment. If the order includes customized products, these products do not have the right of cancellation in accordance with Finnish consumer protection legislation.
Reporting and complaints
All measures will be communicated to the Client by e-mail after the work has been completed. Complaints about the performance of the Work shall be made in writing by letter or e-mail to the Supplier within seven days of the performance of the Work. The Supplier or its partner (e.g. an insurance company's damage inspector) shall have the right to inspect the object of the complaint on site.
Guarantee, liability
The supplier gives a 12-month guarantee on his work. The warranty for equipment purchased through the Supplier shall be governed by the warranty terms of the equipment manufacturer, unless otherwise agreed. Any damage caused by the Supplier on the site shall be covered primarily by the Supplier's liability insurance.
Disputes
If a dispute arises over a commercial contract which cannot be resolved by negotiation between the parties, the consumer can refer the matter to the Consumer Dispute Board (www.kuluttajariita.fi) or the European Commission's online dispute resolution service (https://webgate.ec.europa.eu/odr/). Non-consumer customers: disputes arising from the contract will be resolved primarily by negotiation between the contracting parties, failing which the dispute may be referred to the Vantaa District Court.
